Outside Individual Waivers of Liability and Hold Harmless Agreements

Please find HERE an Athletic Waiver of Liability and Hold Harmless Agreement required to be used with individual outside students brought in for one on one coaching in our athletic facilities.  The Waiver and Hold Harmless Agreement must be signed and sent to Catharine Hennessy at chennessy@stritahs.com prior to the student using the athletic facility. If the outside individual is a minor, the Waiver must be signed by a parent or guardian.

Outside Groups Requesting Use of School’s Facility

Required Facility Use Agreement and Instructions for Required Certificate of Insurance for Outside Groups Requesting Use of School Facility:

Find a required Facility Use Agreement HERE to be used by outside groups who have been approved to use the school’s facilities. Approval for use of the school’s facility must be first obtained from Josh Blaszak, the Principal, for all non-sports related groups or Anthony Avery, the Athletic Director, for all sports related groups. Once approved, the group is required to turn in a completed Facility Use Agreement indicating the following:

  1. The responsible Person(s) for the group;

  2. Date(s), time(s) and area of the school’s facility the group has been authorized to use;

  3. In the Rental notes box on the first page of the agreement, indicate the number of person(s) attending the group’s event broken down by the number of adults and minors in   the group and the number of adults supervising minors (if applicable). 

  4. Along with their completed Facility Use Agreement, the group is required to submit a Certificate of Liability Insurance that certifies and contains the following requirements:

    • A. Facility User has Commercial General Liability Insurance in force at all times during the term of their Facility Use Agreement insuring against claims and liabilities arising out of the operation, condition, use, or occupancy of the school’s premises and all areas appurtenant thereto, including parking areas. Facility User's Auto Liability policy shall insure all vehicle(s), whether hired, owned, or non-owned.

    • B. Facility User's Commercial General Liability Insurance shall at least have the following coverage:

      • General Liability: $1 million per occurrence and $2 million aggregate

      • Commercial Auto Liability: A minimum of $1 million combined single limit is recommended.

      • Property Damage Liability: A minimum of $1 million is recommended.

      • Umbrella: A limit of $5 million per occurrence or aggregate is recommended.

      • Workers' Compensation: Statutory limits are required.

      • Employers' Liability Coverage: A limit of $500,000 is recommended.

      • Professional Liability: Limits of at least $1,000,000 per occurrence and aggregate is recommended. This applies when a supplier has a professional license or designation and is providing professional services.

  • C. The groups Certificate of Liability Insurance ("COI") must also contain the following information:

    • The name and contact information of the policy holder;

    • Relevant policy or account numbers;

    • The name and address of the Insurance Company;

    • The Policy type, coverage start and expiration dates, policy limits and policy deductible.

  • D. The COI must also list St. Rita as an additional insured with respect to liability arising out of the operation, use or occupancy of the school’s premises and all areas appurtenant thereto including parking areas and state that the coverage is primary and any coverage maintained by St. Rita shall be excess of the Facility User’s insurance and shall not contribute with it. 

  • E. Please be further advised that the group’s procuring of the required policy or policies  of insurance shall not be construed to limit the group’s liability under and/or fulfill the indemnification provision or requirements of the Facility User Agreement.  Notwithstanding any policy or policies of insurance, the group shall be obligated for the full and total amount of any damage, injury, or loss caused by negligence or neglect connected with their Facility User Agreement or with their use or occupancy of the school’s premises.

Completion of Facility Use Agreement Process

The final step of the school’s approval process for facility use by outside groups:

Prior to use of the school’s facility, outside groups are required to submit their completed Facility Use Agreement and Certificate of Insurance paperwork to Catharine Hennessy at chennessy@stritahs.com  for review to ensure that they have met all insurance requirements. Ms. Hennessy will notify the group representative if there are any insurance related issues with the Facility Use Agreement or Certificate of Insurance. 

Once the group has met all insurance requirements, Ms. Hennessy will notify the group representative along with the Principal and/or Director of Athletics that the group has completed the approval process to use stated area(s) of the school’s premises on designated date(s) and time(s) so the activity can be added to the Facility/event calendar.
